How will an attorney help in overtime and minimum wage case?

To fully enforce state and federal laws protecting employees from illegal minimum wage and hourly actions by their employers, it is often necessary to seek assistance from an attorney. Unfortunately, individual employees are often powerless against their employers. However, a skilled San Diego employment attorney can use their resources to amplify your case and:

  • Obtain any documentation needed to prove a violation of minimum wage or our laws.
  • Fully prepare any demand letters to your employer asking for full payment you are owed.
  • Prepare to take the case to court if necessary to ensure you are treated fairly by your employer.

Understanding overtime and minimum wage cases

In nearly all circumstances, employers in California and San Diego are required to pay minimum wage. California minimum wage is currently:

  • $13.00 per hour for employers with 26 or more employees.
  • $12.00 per hour for employers with 25 or fewer employees.

Every January 1, these wages will increase a dollar an hour until 2023, to cap out at $15.00 per hour for all workers, regardless of how many people work for their employer.

Municipalities throughout California have different minimum wages. San Diego’s minimum wage, as of 2020, is $13.00 an hour for all employees, regardless of how many people are employed at their place of business. The minimum wage in San Diego will continue to rise along with the California minimum wage until the minimum is $15.00 per hour.

In California, any non-exempt employees are entitled to overtime pay if they work more than eight hours in a single workday or more than 40 hours in a single workweek. Employers are required to pay time and a half for any work in excess of these hours. Additionally, employees must be paid double-time pay if they work more than 12 hours in a single workday or more than eight hours on a seventh consecutive day of work.
